Terms of Service

Effective date: March 3, 2026

These Terms of Service govern your use of services provided by ALBIYA RESOURCES (M) SDN BHD, including scheduled waste collection, transportation, recovery, treatment, and related support services.

1. Scope of Services

Service scope is defined in your quotation, service agreement, or approved work order. Service scheduling, handling method, and turnaround depend on waste type, quantity, site readiness, and regulatory requirements.

2. Client Responsibilities

  • Provide accurate information on waste category, condition, and estimated volume.
  • Ensure containers are properly labeled, sealed, and safely staged for pickup.
  • Provide safe site access and relevant permits or internal approvals where required.

3. Compliance and Safety

Both parties must comply with applicable environmental, health, and safety laws, and follow required handling procedures for hazardous and scheduled waste activities.

4. Pricing and Payment

Fees are based on agreed commercial terms. Additional charges may apply for urgent requests, unexpected waste conditions, access limitations, waiting time, or changes beyond agreed scope.

5. Service Changes and Cancellation

Rescheduling or cancellation requests should be made as early as possible. Late cancellations or aborted collections may be subject to operational charges.

6. Documentation and Records

Operational and compliance documents are issued according to applicable requirements and service scope. Clients are responsible for retaining records needed for their internal and regulatory obligations.

7. Limitation of Liability

To the extent allowed by law, ALBIYA RESOURCES (M) SDN BHD is not liable for indirect or consequential losses, including business interruption, unless expressly stated in a signed agreement.

8. Force Majeure

Neither party is liable for delays or non-performance caused by events beyond reasonable control, including natural disasters, regulatory actions, labor disruptions, or transport restrictions.

9. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes will be resolved under the jurisdiction of the competent courts in Malaysia unless otherwise agreed in writing.
